Mining Expert definition

Mining Expert means the Person that may be agreed to by the Parties after the date hereof and added to Exhibit 5 upon such agreement or any other mining engineer that (a) is experienced with coal and/or lignite mining in the western United States, (b) has no past or present relationship with either Party, and (c) is mutually agreed by both Parties or is selected by the CPR in accordance with Section 6.2(a)(ii).

  • For the avoidance of doubt, the Parties do not intend for the Mining Expert to resolve any such dispute in a way that imposes on TWCC an obligation to carry out Mining Work that does not meet the Minimum Criteria.

  • All disputes regarding the approval of an AOP and all other Minor Disputes, including any Minor Disputes that involve accounting and/or legal issues together with other non-accounting/non-legal issues, shall be referred to a Mining Expert.

  • The Fee Adjustment Basis AOP as ultimately agreed to by the Parties or determined by the Mining Expert shall be the Fee Adjustment Basis AOP for such Year for purposes of the Management Fee adjustments pursuant to this Section 7.4(a).

  • During the feasibility test period, EIA and its Mining Expert Manager will grant PSI full and free access to test fields and sites with the GPR system, to allow PSI to perform under this Agreement, at such reasonable times as may be required by PSI.

  • EIA and its Mining Expert Manager(s) agree to promptly implement such modifications and changes that PSI may make to the GPR system during the feasibility test period, as they are provided by PSI, subject to the provisions of Section 5.

Related to Mining Expert

  • Independent Expert means a Person or entity with no material current or prior business or personal relationship with the Advisor or the Directors and who is engaged to a substantial extent in the business of rendering opinions regarding the value of assets of the type held by the Company.

  • Corrosion expert means a person who, by reason of thorough knowledge of the physical sciences and the principles of engineering and mathematics acquired by a professional education and related practical experience, is qualified to engage in the practice of corrosion control on buried or submerged metal piping systems and metal tanks. Such a person must be accredited or certified as being qualified by the National Association of Corrosion Engineers or be a registered professional engineer who has certification or licensing that includes education and experience in corrosion control of buried or submerged metal piping systems and metal tanks.

  • Teaching Experience means experience in which the licensed teacher is actually instructing pupils in a classroom set- ting on a continuous basis.

  • Expert is defined in Section 7.9 of this Agreement.

  • Professional surveyor means a person who, by reason of knowledge of law, mathematics, physical sciences, and techniques of measuring acquired by professional education and practical experience, is qualified to engage in the practice of professional surveying.
