If there is a settlement before trial, the Claimants agree that no detailed account will be taken of the individual merits or demerits of individual Claimants’ cases (if any) and accept that adjudicating between individual Claimants’ cases would be disproportionately expensive and burdensome, so that it is agreed that the proceeds of settlement will be distributed fairly in accordance with advice received from Leading and Junior Counsel.
