Environmental Offset definition

Environmental Offset means activities or works that:
Environmental Offset has the meaning given under the EO Act. EO Act means the Environmental Offsets Act 2014.
Environmental Offset means an action or actions taken in accordance with these Regulations, after all reasonable Mitigation measures have been applied, to compensate or counterbalance significant Residual Environmental Changes resulting from Exploitation Activities in the Area, by replacing or providing substitute resources or environments.

Examples of Environmental Offset in a sentence

  • Item 1 Environmental Offset Application Number Insert the environmental offset application number shown on the Notice of Decision Item 2 Entity Insert the name/s of the entity/entities.

  • The purchase price for the Stock (the “Purchase Price”) shall be an amount equal to Forty Three Million Dollars ($43,000,000), less the sum of (a) the Environmental Offset Amount, if any, and (b) Five Million Seven Hundred Fifty Thousand Dollars ($5,750,000) (the “Transferred Plan Underfunding Amount”), subject to adjustment pursuant to Section 1.5(a).

  • For the avoidance of doubt, the Seller shall not be entitled to any portion of the Environmental Offset Amount in the event that the Aggregate Environmental Losses in excess of One Million Dollars ($1,000,000) exceed the Environmental Offset Amount.

  • CONTRIBUTION The Landowner must transfer the Environmental Offset Land to the Environment Minister or his nominee.

  • C Pursuant to the Notice of Decision part of the Environmental Offset is to be delivered on land owned by the Offset Landowner.

  • The Landowner undertakes to provide the Road Contributions as a works-in-kind and provide the Environmental Offset Land Contribution set out and provided for in Column 1 of the table below no later than the date or event described in Column 2 of the table below.

  • In the event that any Aggregate Environmental Losses exceed the sum of (i) the Environmental Offset Amount plus (ii) One Million Dollars ($1,000,000), Buyer shall have the right to use the Escrow Amount (together with all interest accrued thereon), if any, to satisfy any such excess amounts.

  • Within 10 Business Days of execution of this deed, the Developer will provide security to the Minister to secure the Developer’s obligation to pay the Environmental Offset Contribution Amount in the form of the Environmental Offset Contribution Bank Guarantee.

  • For the avoidance of doubt, Environmental Losses satisfied by Buyer from the Environmental Offset Amount shall be deemed to be amounts paid in satisfaction of Seller’s indemnification obligation under this Section 8.6(a).

  • C Pursuant to the Notice of Decision all/part of the Environmental Offset is to be delivered on land owned by the Offset Landowner.

Related to Environmental Offset

  • Environmental Obligation shall have the meaning given such term in Section 4.3.1.

  • Environmental Violation means any activity, occurrence or condition that violates or results in non-compliance with any Environmental Law in any Material respect.

  • Environmental Loss means any loss, cost, damage, liability, deficiency, fine, penalty or expense (including, without limitation, reasonable attorneys' fees, engineering and other professional or expert fees), investigation, removal, cleanup and remedial costs (voluntarily or involuntarily incurred) and damages to, loss of the use of or decrease in value of the Equipment arising out of or related to any Adverse Environmental Condition.

  • Environmental Clean-up Site means any location which is listed on the National Priorities List, the Comprehensive Environmental Response, Compensation and Liability Information System, or on any similar state or foreign list of sites requiring investigation or cleanup, or which is the subject of any pending or threatened Proceeding related to or arising from any alleged violation of any Environmental Law, or at which there has been a threatened or actual Release of a Hazardous Substance.

  • Environmental Contamination means the introduction or presence of Hazardous Materials at such levels, quantities or location, or of such form or character, as to constitute a violation of federal, state or local laws or regulations, and present a material risk under federal, state or local laws and regulations that the Premises will not be available or usable for the purposes contemplated by this Agreement.
