Enacted Budget means the State budget passed by the California Legislature and set to be signed into law by the Governor on June 15, 2020), any revisions to the Enacted Budget, and/or any budget proposals passed by the State Legislature are projected to result in an increase or decrease in the District’s 2020/2021 revenues received from the State by 2% or more (“Change in Received Revenue”), then negotiations on the Agreement may be unilaterally reopened on the following items only, unless otherwise mutually agreed upon: salary; adjustments to step and column advancement; the calendar; and the articles regarding hours, workdays, and work year. In addition, if the State allows a reduction in the number of instructional days (“Reduction in Days”), the same topics described above can be unilaterally reopened. The District shall notify the Association of the Change in Received Revenue and/or Reduction in Days no later than 30 days following the District’s receipt of the notice of the Change in Received Revenue and/or Reduction in Days. Either party who wishes to reopen negotiations under this paragraph shall give notice in writing within 60 days of the District’s notification to the Association of the Change in Received Revenue and/or Reduction in Days. The terms and definitions of Change in Received Revenue and Reduction in Days shall be interpreted broadly, in favor of allowing the re-opening of negotiations in the event that there is a material change in the District’s received revenue as defined herein. CERTIFICATED BENEFITS 2019/2020: - Augmentation of the health/welfare benefits cap (currently at $8,036) to $8,500 for the 2019- 2020 school year for Certificated Bargaining Unit Members, with no in lieu payment. 2020/2021: - Augmentation of the health/welfare benefits cap (currently at $8,036) to $9,000 for the 2020- 2021 school year for Certificated Bargaining Unit Members, with no in lieu payment. - Certificated CBA (Art. Enacted Budget. The Broker’s capitation rates include dollars allocated from the SFY 2019 Enacted Budget. The Broker agrees to comply with all applicable Federal laws and regulations.
