Discrimination Claim means any claim brought by any Employee relating to the exclusion from, a limitation of benefits under, any pension plan offered to any such employees of the Seller prior to the Effective Date (whether or not including the Employees) on the grounds of (directly or indirectly) sex, race, religion, age, sexual orientation, disability, part-time or fixed-time status;

  • In disputes where Executive asserts a Statutory Discrimination Claim, reasonable attorneys’ fees shall be awarded by the arbitrator based on the same standard as such fees would be awarded if the Statutory Discrimination Claim had been asserted in state or federal court.
