Although this procurement is being conducted under the Competitive Procedure with Negotiation (CPN), in accordance with Regulation 30 of The Public Contracts (Scotland) Regulations 2015 (the Regulations), it is structured differently from a typical CPN process, where only shortlisted bidders are invited to tender.
The Competitive Procedure shall be organised and conducted in compliance with applicable laws of Romania and with the EBRD Policy for the Financing of Private Parties to Concessions (BDS15-233 (F)) (such policy, as it may be amended or replaced from time to time, the "EBRD Concession Policy").
In furtherance of and without limiting Clause 9(a) above, the Parties agree that EBRD financing will not in any manner be given preference over other sources of financing available for the Project, and that it will be at the absolute discretion of the Competitive Procedure participants and the Private Investor to decide on how to structure the Project funding package, subject to the provisions of the Competitive Procedure documentation and the Project Agreement.
