For example, when making a justification on the basis of price of new or repowered fossil fuel-fired generation, the IOU may compare offer prices to prices reflected in sources such as Cambridge Energy Research Associates' capital cost index, CPUC estimates of new fossil fuel-fired generation, CEC estimates of new fossil fuel-fired generation, forward market prices, or other similar third-party information regarding the cost of new generation CHP Facilities in California.
Subject to force majeure conditions, Sellers under PPAs for New CHP Facilities or Repowered CHP Facilities will be required to commence deliveries on the earlier of the following two events: (a) five (5) years after CPUC approval of the PPA, or (b) the Term Start Date in the PPA.
Efficient CHP Facilities as compared to the Double Benchmark will be counted as a GHG Credit.

The MWs counted for New PPAs executed with Existing CHP Facilities will be the published Contract Nameplate value, unless otherwise noted in this Settlement.
To the extent required by Applicable Law, administration of this Agreement or program eligibility guidelines established by the California Energy Commission, within thirty (30) Business Days following the Term Start Date or Notice from Buyer, Seller shall provide to Buyer certification from the California Energy Commission that the Generating Facility meets the applicable operating and efficiency standards for Eligible CHP Facilities for the applicable year.
Changes or deviations from the plans and/or specifications shall not be made without authority in writing from CHP Facilities Coordinator.
