  • Bornish acknowledges and agrees that the County shall be entitled to draw on and use the proceeds of the Second LC to complete the Final Repairs in the event Bornish fails to do so within a reasonable period of time, in accordance with Section 36 of this Agreement.

  • In the event of default by Bornish and without such default being rectified within the time period referred to in this section, the County shall have the right to terminate this Agreement.
