  • If at the time Syngenta gives notice to Diversa, Diversa has granted a Third Party(ies) an exclusive license or if Diversa has undertaken or planned to undertake such internal project as described above with respect to the entire Syngenta Exclusive Field, then Diversa shall have no obligation to grant a license to Syngenta with respect to such Biomolecule for the duration of the Third Party’s(ies’) license or the internal project.

  • The initial site shall include both [ * ]’s site (which may be used solely to manufacture the registration batches and the launch supply of Biomolecule for the country or the group of countries for which the first Regulatory Approval is obtained) and Pfizer’s initial site, including the expansion of a facility within such site.

  • Quark shall keep Pfizer informed of the status of all pending patent applications that pertain to any Biomolecule or any Licensed Product.
