• If the disputed amount of the payment is found to be incorrect, Kenergy or Big Rivers, as applicable, shall promptly cause to be refunded to Century the amount that was not then due and payable, together with interest at the Prime Rate commencing on the first day after the date of payment and accruing on each day thereafter until the date the refund is made.

Big Rivers. Performance Responsibility. The LG&E Companies, with respect to their respective performance obligations under this Section 8, have agreed to indemnify and save harmless Big Rivers in the manner set forth in Section 10.15(a) of this Agreement.

Big Rivers and “Kenergy” shall mean Big Rivers Electric Corporation and Kenergy Corp. as defined and identified in the first paragraph of this Request for Information.
