Active mediation definition

Active mediation means that PRODECON is not only a mute witness of the process; to the contrary, as the ruler of this procedure and expert in tax matters, can assist and help the parties to create the best-balanced atmosphere in order to overcome the conflict. This “active” role, in practice, gives PRODECON the chance to propose a possible solution to the parties, especially in cases of high complexity.

  • Mediation means any process in which a mediator facilitates communication and negotiation between the parties to assist them in reaching a voluntary agreement regarding their dispute.

  • Remediation Services means the additional services required to be provided hereunder by BNYM or the Custodian in connection with a Fund Error in order to correct, remediate, adjust, reprocess, repeat, reverse or otherwise modify conduct previously taken in accordance with the Agreement to achieve the outcome originally intended by the previous conduct.

  • Panel means the Panel on Takeovers and Mergers;

  • Mediation party means a person that participates in a mediation and whose agreement is necessary to resolve the dispute.

  • Mediator has the meaning given to it in clause 9.3.1
