Common use of Xxxxxx’s Commissions Clause in Contracts

Xxxxxx’s Commissions. Except for brokers that shall be paid by Owner, Owner and ACC represent and warrant to each other that neither party has dealt with a broker, salesperson or finder with respect to this Agreement or the transactions contemplated herein, and that, except for commissions that shall be paid by Owner, no fee or brokerage commission will become due by reason of the transactions contemplated by this Agreement. The parties will indemnify, defend and hold harmless each other from all costs, liabilities, expenses and reasonable attorney’s fees arising out of the breach of this Section.
