Common use of WORK TO BE PERFORMED AND DOCUMENTS Clause in Contracts

WORK TO BE PERFORMED AND DOCUMENTS. For and in consideration of the sums of money hereinafter specified to be paid by the City to the Contractor for the Work provided for in this Contract and in the Contract Documents to be performed by the Contractor, the Contractor hereby covenants and agrees with the City to fully construct, perform, and complete the Work in a good and workmanlike manner in accordance with this Contract and the Contract Documents to produce a fully functional and properly operating project within the time stipulated, time being made of the essence of this Contract. It is also agreed by the parties hereto that the Contract Documents consist of this Contract and those items set forth in the definition of Contract Documents in Section 1 of the General Conditions and includes the following, all of which are and constitute a part of this Contract as if attached hereto or set out in full herein, viz: Project Manual ITB# 19-01-08 dated November 15, 2018 including: Invitation to Bid; Instructions to Bidders; General Conditions; Supplemental General Conditions, if any; Plans and Drawings; Specifications; Special Conditions or similar documents, if any; Bid Form completed by Contractor for this project; Contractor's Performance Security; Contractor's Labor and Material Payment Security; The terms, conditions, and provisions as contained in the VDOT Agreement dated September 9, 2013, between the City and VDOT and Extension Addendum, Revenue Sharing Projects dated May 31, 2016.
