Common use of Waterproofing Clause in Contracts

Waterproofing. No leaks of water into a basement of any residence are acceptable. However, leaks caused by improper landscaping installed by Purchaser, or failure of Purchaser to maintain proper grades are not covered by the Warranty. Dampness of the walls is often common to new construction and is not considered a deficiency. The Builder will take such action as necessary to correct basement leaks except where the cause is determined to result from Purchaser’s negligence.
