Userra Contributions Clause Samples
The USERRA Contributions clause outlines the employer's obligations to make retirement plan contributions for employees who are absent due to military service, as required by the Uniformed Services Employment and Reemployment Rights Act (USERRA). In practice, this means that if an employee is called to active military duty, the employer must treat their period of service as continuous employment for the purposes of retirement benefits, making up any missed contributions upon the employee's return. This clause ensures that employees serving in the military do not lose out on retirement benefits, thereby protecting their long-term financial security and ensuring compliance with federal law.
Userra Contributions. Effective for each person who is or becomes a Participant, has a period or periods of qualifying service in the uniformed services, is reemployed by the Employer on or after December 12, 1994, and is reemployed within the time prescribed by law (and notwithstanding anything apparently to the contrary in other provisions of this Plan Statement):
Userra Contributions. A Participant who returns from uniformed service under USERRA shall be entitled to Credited Service during the period of leave provided he pays the Participant contribution he would have paid had he worked during the period of uniformed service. The repayment shall be made during the period beginning with his Reemployment Commencement Date and ending on a date which is no later than three (3) times the duration of his uniformed service, but in no event later than five (5) years.
