Common use of User Representations Clause in Contracts

User Representations. The USER hereby represents and warrants that, 1) The User is solely responsible for obtaining, at his own cost, all licenses, permits, consents, approvals and intellectual property or other rights as may be required by law for using the Service. 2) USER's usage, and access to the JOBJET URL or digital platform will not violate any applicable law or regulations. 3) All registration, documents, and information that USER will submit shall be true, accurate, correct, uncut, non-fictitious, and complete; USER will maintain the accuracy of such information and promptly update such information as necessary. 4) USER shall not misuse, defraud, or mislead the information received on TAXSUTRA’s digital platform or from the Employer/ Employee as applicable. USER debarred from the use of JOBJET URL for any illegal, forbidden, or unauthorized purpose. 5) If USER provides any information that is untrue, inaccurate, manipulated, wrong, not current, or incomplete, with deceitful intention, or misrepresented, TAXSUTRA reserves the right to not post any job or to suspend or to terminate USERs account/ subscription and/or refuse to deliver any or all current or further services. 6) USER shall be liable under appropriate law and order for making improper use of our support services or for submitting false reports, fake documents, edited photocopy’s/scan copies, false details, misrepresentation, information or abuse, or misconduct. 7) If USER provides information for or on behalf of another individual or person or body corporate (whether registered or not), such USER should be doing so with the consensus of that person after fully understanding the implications of this action. TAXSUTRA will not be held responsible if the USER is doing this without the knowledge/consensus of that person concerned. 8) USER agrees to use the JOBJET URL only to post, send and receive messages and material that are proper and related to the particular Service. By way of example, and not as a limitation, USER agrees that while using ONLINE SERVICEs, USER shall not: i. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topic, name, material, or information. Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents. ii. Defame, abuse, harass, stalk, threaten, or otherwise violate legal rights (such as rights of privacy) or others. iii. Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer etc.

User Representations. The USER You hereby represents represent and warrants warrant to Tencap Tennis that, : (a) you (i) have reached the age of majority in the jurisdiction where you reside (generally 18, 19 or 21 years of age depending on the jurisdiction), (ii) are an emancipated minor under the laws of your jurisdiction of domicile and/or residence or (iii) otherwise have the power and authority to enter into and perform your obligations under this Agreement; (b) all information provided by you to Tencap Tennis is truthful, accurate and complete; (c) you are an authorized signatory of the credit or debit card or other method of payment that you provide to Tencap Tennis or its third-party payment processor to pay the purchase price and any applicable fees or taxes related to your purchases of products and/or services via the Web Site; (d) you will comply with the terms and conditions of these Terms of Use and any other agreement to which you are subject that is related to your use of the Web Site or any part thereof; (e) you have provided and will maintain accurate and complete registration information with Tencap Tennis, including, without limitation, your legal name, address, email address, and any other information Tencap Tennis may reasonably require; (f) your access to and use of the Web Site or any part thereof and/or purchase and use of any products or services will not constitute a breach or violation of any other agreement, contract, terms of use or any law or regulation to which you are subject; (g) you will immediately notify Tencap Tennis in the event that you learn or suspect that your registration information, username or password has been disclosed or otherwise made known to any other person; and (h) if you purport to be the agent of, represent or otherwise act on behalf of an Organization, entity or any other person, that you are in fact an authorized representative of such Organization, entity or other person. Upload files that contain store viruses, corrupted filesTrojan horses or any other malicious code or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, system or telecommunications equipment; (e) use of the Web Site to post, store or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or other fraudulent schemes, or any other similar software form of solicitation (including, without limitation, using the Web Site to send unsolicited commercial or programs that promotional messages to other parties, and using the Web Site to connect to people who do not know you and then sending them unsolicited commercial or promotional messages without their permission); (f) forging headers or otherwise manipulating identifiers in order to disguise the source or origin of any communications transmitted through the Web Site; (g) use of any manual or automated software, devices or other processes to "crawl" or "spider" any web pages contained in the Web Site (including, without limitation, the use of robots, bots, spiders, scrapers or any other means to extract pricing, product, service or other data from the Web Site); (h) framing or otherwise simulating the appearance or functions of the Web Site or any portion thereof; (i) harvesting or otherwise collecting any information about other Users, including, without limitation, email addresses or other contact information of other Users; (j) alter the account information of a user or alter User Content posted by a user when you have not been granted privileges to do so; and (k) use of the Web Site to engage in any activity that, as determined by Tencap Tennis, may damage intentionally or unintentionally violate these Terms of Use, violate any applicable laws or regulations or conflict with the operation spirit or intent of another’s computer etcthese Terms of Use.

You are solely responsible for obtainingthe information that you post on or through the Licensed Materials and your conduct regarding the Licensed Materials.
