Common use of Use of Trade Names Clause in Contracts

Use of Trade Names. After the Closing Date, neither Seller, nor any person controlling, controlled by or under common control with Seller will for any reason, directly or indirectly, for itself or any other person, (a) use the name "GlassCity Internet," or (b) use or disclose any trade secrets, confidential information, know-how, proprietary information or other intellectual property of Seller transferred pursuant to this Agreement.

Use of Trade Names. After the Closing DateClosing, neither Seller, nor any person controlling, controlled by or under common control with Seller Seller, will for any reason, directly or indirectly, for itself or any other person, (a) use the Marks (or any other name "GlassCity Internet," which is a variation thereof or otherwise confusingly similar therewith) or any other names which are currently used by Seller in conjunction with the Business, or (b) use or disclose any trade secrets, confidential information, know-how, proprietary information or other intellectual property Intellectual Property of Seller transferred pursuant to this Agreement.

After the First Closing Date, neither Seller, nor any person controlling, controlled by or under common control with Seller will for any reason, directly or indirectly, for itself or any other person, (a) use the name names "GlassCity Internet,MetroLink" or "MetroLink Internet Services" or (b) use or disclose any trade secrets, confidential information, know-how, proprietary information or other intellectual property Intellectual Property of Seller transferred pursuant to this Agreement.

After the Closing Date, neither any Seller, nor any person controlling, controlled by or under common control with any Seller will for any reason, directly or indirectly, for itself or any other person, (a) use the name names "GlassCity Internet,Raex" or "xxxx.xxx" or "xxxx.xxx" or (b) use or disclose any trade secrets, confidential information, know-how, proprietary information or other intellectual property of any Seller transferred pursuant to this Agreement.
