Common use of Use of BellSouth Certified Supplier Clause in Contracts

Use of BellSouth Certified Supplier. WinStar shall select a supplier which has been approved as a BellSouth Certified Supplier to perform all engineering and installation work. WinStar and WinStar’s BellSouth Certified Supplier must follow and comply with all BellSouth requirements outlined in BellSouth’s XX 00000, XX 00000, XX 00000, and TR 73564. In some cases, WinStar must select separate BellSouth Certified Suppliers for transmission equipment, switching equipment and power equipment. BellSouth shall provide WinStar with a list of BellSouth Certified Suppliers upon request. The BellSouth Certified Supplier(s) shall be responsible for installing WinStar's equipment and components, extending power cabling to the BellSouth power distribution frame, performing operational tests after installation is complete, and notifying BellSouth's equipment engineers and WinStar upon successful completion of installation, etc. The BellSouth Certified Supplier shall xxxx WinStar directly for all work performed for WinStar pursuant to this Exhibit and BellSouth shall have no liability for nor responsibility to pay such charges imposed by the BellSouth Certified Supplier. BellSouth shall consider certifying WinStar or any supplier proposed by WinStar. All work performed by or for WinStar shall conform to generally accepted industry guidelines and standards.

WinStar Powertel and WinStarPowertel’s BellSouth Certified Supplier must follow and comply with all BellSouth requirements outlined in BellSouth’s XX 00000, XX 00000, XX 00000, and TR 73564. In some cases, WinStar Powertel must select separate BellSouth Certified Suppliers for transmission equipment, switching equipment and power equipment. BellSouth shall provide WinStar Powertel with a list of BellSouth Certified Suppliers upon request. The BellSouth Certified Supplier(s) shall be responsible for installing WinStarPowertel's equipment and components, extending power cabling to the BellSouth power distribution frame, performing operational tests after installation is complete, and notifying BellSouth's equipment engineers and WinStar Powertel upon successful completion of installation, etc. The BellSouth Certified Supplier shall xxxx WinStar bill Powertel directly for all work performed for WinStar Powertel pursuant to this Exhibit Agreement and BellSouth shall have no liability for nor responsibility to pay such charges imposed by the BellSouth Certified Supplier.
