The 'Use and Construction' clause defines how a property, asset, or item may be utilized and what activities or modifications are permitted. Use and Construction. 5.8.1 The Approved Project's respective existing uses is lawful use permitted under:
(a) Applicable Laws, regulations, orders or official directions; and
(b) the relevant Government Lease and deeds of mutual covenants, and that permission is not temporary or personal.
5.8.2 Any permits, licences, waivers, consents or other authorisations necessary for the Approved Project's existing use, and its original construction and any subsequent alteration, has been obtained and is in force, unimpeachable and unconditional or subject only to conditions that have been satisfied in full and none are given on a temporary basis.
5.8.3 There are no unauthorised or illegal structures or alterations or works or building works on, in, at or appertaining to the Approved Project or any part thereof and there is no illegal change of use of the Approved Project.
Use and Construction. 8.6.1 The Property's existing use as stated in schedule 5 is the lawful use permitted under:
(a) applicable laws, regulations, orders or official directions;
(a) the relevant government leases (or government conditions) and deeds of mutual covenants; and
(b) in the case of the Other Property, the terms of the relevant lease, tenancy or licence, as varied by any supplemental deed or document and in neither case is that permission temporary or personal.
8.6.2 Any permission necessary for the Property's existing use, is in force.
Use and Construction. 30.9.1 The Properties’ existing use is the lawful use permitted under:
(a) applicable town and country planning legislation; and
(b) the terms of the lease, tenancy or licence, as varied by any supplemental deed or document, and in neither case is that permission temporary or personal.
30.9.2 Any permission necessary for any of the Properties’ existing use, its original construction and any subsequent alteration and development has been obtained and is in force.
30.9.3 There is no outstanding order, notice or other requirement of any local or other authority that affects the Properties’ existing use or involves expenditure by the Company in complying with it nor any circumstances known which may result in any such order or notice being made or served.
Use and Construction. Section 8.1 Use and Management of Demised Premises
(a) Subject to section 5.5, the Tenant shall develop, use, manage and operate the Demised Premises solely, continuously and actively after the Commencement Date only for the Contemplated Use, in accordance with the requirements of the Contribution Agreement, Project Agreement, the Heritage Agreement and this Lease, including the Residential Tenancies Protocol. The Tenant shall not use or permit the use of the Demised Premises or any part thereof for any other business or purpose except as may be permitted under the Contribution Agreement, the Project Agreement, the Heritage Agreement and this Lease or as otherwise consented to by the Landlord, acting reasonably.
(b) The Tenant shall be permitted to lease, sublease or licence Residential Units in the Building and permit occupancy of the Building only in accordance with the terms of this Lease and the Contribution Agreement.
(c) The Tenant shall protect all public works services and/or utilities and all easements and right-of-way in favour of the Landlord on above, under or affecting the Demised Premises. Notwithstanding the foregoing, the Tenant shall not be in default of its obligations under this Section 8.1 to the extent that it has ceased to operate in connection with any circumstance or delay contemplated by Section 15.11 hereof or any event of Force Majeure (as such term is defined in the Contribution Agreement); in connection with any repair or restoration work after damage or destruction; or any alteration, remodelling, renovation or expropriation or pursuant to any permitted Transfer of this Lease.
