Unvested Benefits Under Defined Benefit Plan. To the extent not paid pursuant to clause (iii) or (iv) of this Section 4.1(a), an amount equal to the actuarial equivalent present value of any unvested portion of Executive’s accrued benefits or cash balance account (as applicable) under any tax-qualified (under Section 401(a) of the Code) defined benefit retirement plan maintained by the Employer as of the Termination Date and forfeited by Executive by reason of the Termination of Employment; and
