Common use of Uninsured Losses; Proceedings Against Assets Clause in Contracts

Uninsured Losses; Proceedings Against Assets. There shall occur any uninsured damage to or loss, theft or destruction of any portion of the Collateral with a fair market value in excess of the Threshold Amount or the Collateral or any other of the Loan Parties’ or any of their Subsidiaries’ assets with a fair market value in excess of the Threshold Amount are attached, seized, levied upon or subjected to a writ or distress warrant; or such come within the possession of any receiver, trustee, custodian or assignee for the benefit of creditors and the same is not cured within thirty (30) days thereafter;

There shall occur any uninsured damage to or loss, theft or destruction of any the assets of the Loan Parties or their Subsidiaries where the uninsured portion of the Collateral with a fair market value such damage, loss, theft or destruction is in excess of the Threshold Amount Amount; or the Collateral or any other assets of the Loan Parties’ Parties or any of their Subsidiaries’ assets with Subsidiaries having a fair market value in excess of the Threshold Amount are attached, seized, levied upon or subjected to a writ or distress warrant; or such come within the possession of any receiver, trustee, custodian or assignee for the benefit of creditors and the same is not cured within thirty (30) days thereafter;

There shall occur any uninsured damage to or loss, theft or destruction of any portion of the Collateral with assets or properties of a fair market value in excess of the Threshold Amount or the Collateral Loan Party or any other Subsidiary of a Loan Party that constitutes a Material Adverse Change, or any of the Loan Parties’ ' or any of their Subsidiaries’ ' assets with a fair market value in excess of the Threshold Amount $2,250,000 or greater are attached, seized, levied upon or subjected to a writ or distress warrant; or such come within the possession of any receiver, trustee, custodian or assignee for the benefit of creditors and the same is not cured within thirty (30) days thereafter;

There shall occur any material uninsured damage to or loss, theft or destruction of any portion of the Collateral with a fair market value in excess of the Threshold Amount $1,000,000 (excluding normal and customary policy deductibles), or the Collateral Collateral, or any other of the Loan Parties’ ' or any of their Subsidiaries’ ' assets with a fair market value in excess of the Threshold Amount $1,000,000, are attached, seized, levied upon or subjected to a writ or distress warrant; or such come within the possession of any receiver, trustee, custodian or assignee for the benefit of creditors and the same is not cured within thirty (30) days thereafter;
