5.3. Where You are not liable for an unauthorized Transaction, we will refund the value of that Transaction and will have no further liability to you for any other losses You may suffer. If Our investigations conclude that the Transaction you have disputed has been authorized by You, or other unauthorized use on Your behalf, or You have acted fraudulently, We will not refund the value of the Transaction.
5.4. You should check your Card or code, and we can prove that we could have stopped someone from using your Card or code without your permission, you could lose as much as $500. (Under California law, this paragraph does not apply to the VISA® Debit Card even if the unauthorized use is exempt from the VISA® zero liability rule.) Also, if your statement shows unauthorized transactions, tell us at onceTransaction history regularly. (2b) business days we are not notified by you about the unauthorized transaction, or we are notified after you learn the applicable Notification Deadline specified in Section 11.1;
(c) we are not notified, or are notified late of any security issues with the Nium Account and/or your Platform, about the loss, thefttheft or misappropriation of the Pay In or Pay Out services or the Nium Account. You will be responsible for all transactions that occurred before the date when you notify us and we will not issue a refund for any unauthorized transactions that occurred before we were notified;
(d) you and/or Nium Account user deliberately, or other with gross negligence (i.e., extremely carelessly), compromised the security of the Nium Account, or fail to use the Pay In or Pay Out services or the Nium Account in accordance with these Terms; or
(e) the Nium Account was misappropriated (i.e., used by someone else).
11.3. We may investigate unauthorized use and incorrectly executed transactions. We will have the right to investigate any transaction reported by you as unauthorized or executed incorrectly. We may ask you to provide us with supporting information and documentation to help us with our investigation and you agree to cooperate with us and provide to us all information and documentation we reasonably require for this purpose. You also agree to cooperate with any authorities involved in our investigation. We will treat any payment instruction given via the Platform or Platform Provider as evidence of your Card or codeauthorization of the payment, and in this case you will need to provide us with evidence to show that the transaction was not authorized in accordance with these Terms.
11.4. Can we can prove that we could have stopped someone from using your Card or code without your permissiontake back the refund? If, you could lose as much as $500. We will not be held liable for any Transaction that was unauthorised or incorrectly executed if you have failed to contact us without undue delay – in these circumstances you may be held liable for the entire loss of theftthe Transaction. You should also describe the disputed Transaction in writing, you can lose no more than $50 if someone used your card or PIN without your permission. 20.2. You agree to safeguard your Card against unauthorized use by taking all reasonable precautions. You may not bring any claim against West Bank for an unauthorized transaction, including forgeries, alterations, counterfeits, unauthorized signatures, or any other errors or unauthorized charges, unless you provide notice to West Bank within sixty (60) days after of the statement was mailed to you, we are not obligated to refund date of your statement. In the event of any money you recovery of funds lost after the sixty (60) days, if we can prove that we could have stopped someone from taking the money if you had told us in time. That means you could lose all the money in or stolen as a result of any errors or unauthorized transactions associated with your account plus your maximum overdraft line of credit. Unauthorized Transactions. All EFTs Your Liability 12.1 If the Cardholder becomes aware, in any way and/or by reviewing the monthly Card Account Statement, of any unauthorized transactions, he should immediately notify the Bank. Failure to promptly notify the Bank of an unauthorized transaction as per Term 9.5 hereinabove, shall entail loss of the Cardholder’s right to correct the error, if any, and the Bank shall not be liable for Unauthorized Use Tell us AT ONCE if you believe that your Cardany damage or loss against the Cardholder.
12.2 If a payment transaction is carried out without the Cardholder’s authorization, PINthe Bank shall immediately and, or Internet Bankingin any case, Mobile Banking and Bill Payment password or access code has been lost or stolen or may be subject to unauthorized use, or if you believe that an electronicfund transfer has been made without your permission using information from your check. Please refer to the “HOW TO CONTACT US” section at by the end of this Agreement the next business day the latest, following relevant notification of the Cardholder, refund to the Cardholder the relevant amount which was debited to the Card Account and shall restore the said Account by reversing the unauthorized transaction. If a payment service provider is involved, the Cardholder shall claim rectification from the Bank.
12.3 If the unauthorized payment transaction has been carried out with a lost, stolen or misappropriated Card, the following shall apply:
(a) The Cardholder is charged with an amount of up to Euro fifty (€50) for how the damage incurred unless:
(i) loss, theft or misappropriation of the Payment Instrument could not be detected by the Cardholder prior to the payment; or
(ii) the Bank did not provide this notification. Telephoning is the best way to keep losses down. You could lose all the money in your account plus your maximum overdraft line necessary means to enable the notification of credit if you fail to promptly report loss, theft, misappropriation or unauthorized use of an ATM the Payment Instrument by third parties.
(b) The Cardholder is liable for the damage in full if the following conditions are met:
(i) the damage resulted from the fact that the Cardholder wilfully or out of gross negligence violated one or more of his obligations, as follows: (1) to use the Card in line with the contractual terms governing the issue and use thereof; (2) to take, immediately upon receipt of the Card, Internet Bankingany reasonable measures in order to keep his personalized security features secure; and (3) to notify the Bank or the person appointed by the Bank promptly on becoming aware of loss, Mobile Banking and Bill Payment, theft or certain misappropriation or unauthorized use of a VISA® Debit the Card. If you believe your Card or code ; and
(ii) the Bank has been lost or stolen or otherwise made available provided every means necessary to an unauthorized person, and you tell us within two (2) business days after you learn of enable the loss of theft, you can lose no more than $50 if someone used your card or PIN without your permission.
