Transfer of District Programs. The Board and Superintendent will not arrange for the transfer of all or part of any existing District program or any personnel to BOCES without first delivering notice of such transfer in writing to the President of the Association.

  • Medical Transfers The District shall give alternate work, when it is available, to a Unit Member who has become medically unable to satisfactorily perform the Unit Member’s regular job classification duties. The alternate work may constitute lateral transfer or voluntary transfer to a lower classification. The District may require a statement from a licensed physician certifying that the Unit Member is medically able to perform the duties of the alternate work.

  • Limitation of District Liability Other than as provided in this Agreement, District’s financial obligations under this Agreement shall be limited to the payment of the compensation provided in this Agreement. Notwithstanding any other provision of this Agreement, in no event, shall District be liable, regardless of whether any claim is based on contract or tort, for any special, consequential, indirect or incidental damages, including, but not limited to, lost profits or revenue, arising out of or in connection with this Agreement for the services performed in connection with this Agreement.
