Common use of TOIL Clause in Contracts

TOIL. Department Manager approval is required before TOIL can be accrued. Employees may work up to 90 hours per fortnight at the ordinary rate of pay. Additional time worked in accordance with the above shall be accrued as Time off in Lieu (TOIL). Hours worked in excess of 90 ordinary hours worked shall be paid at overtime rates. Approved TOIL shall be taken at a time mutually agreed between the employer and employee. The expectation is for TOIL to be taken within six months and a maximum of 3 days only to accrue. Any time in excess of 3 days shall be paid out in the current pay period.
