Third Party comparison. Furthermore, this General Agreement and the Set of Contracts (as defined below) shall be drafted and construed without taking into account that the Parties are affiliated companies. Therefore, this General Agreement and modules attached hereto shall be in accordance with arm’s length principles and stand third Party comparison. In order to achieve this purpose, FME and NETCARE have commissioned Ernst & Young GmbH Wirtschaftsprüfungsgesellschaft to issue a fairness opinion on the comparability of the terms and conditions of this present Set of Contracts with third Party agreements.
