The Protocols. The protocol for the Phase 3 Trial (the “Phase 3 Trial Protocol”) as it exists on the Effective Date has separately been mutually agreed upon by the Parties in writing. The protocol for each Clinical Trial (other than the Phase 3 Trial) of the Product to be conducted in the SFJ Territory (each, an “SFJ Territory Clinical Trial Protocol”) will be prepared by SFJ in consultation with PhaseBio and approved by the JDC within [***].
