Common use of The Contracts (Rights of Third Parties) Xxx 0000 Clause in Contracts

The Contracts (Rights of Third Parties) Xxx 0000. No person who is not a Party to the Agreement (including without limitation any employee, officer, agent, representative, or sub-contractor of either the Commissioner or the Contractor) shall have any right to enforce any term of the Agreement, which expressly or by implications, confers a benefits on him without the prior agreement in writing of both Parties, which agreement should specifically refer to the Condition 37. This clause does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.
