Common use of Testing and Monitoring Clause in Contracts

Testing and Monitoring. The testing of the dispatch signalling must be completed at least one month prior to the initial start date for the provision of services under this contract. The Company also reserve the right to request additional Proving Tests (test of ability to deliver a response) at its discretion. Proving tests will be limited to once every 6 months, provided that the test result is in line with Company expectations. Utilisation payments will apply for proving tests as requested by the Company. Should the Company identify a failure affecting the communications at any time during the contract the Company shall notify the Providers nominated person as soon as practical in order to resolve the failure and if necessary, retrieve any missing data. Following a communications failure, the company may request the Provider complete further testing.
