Termination prior to Commencement of Remediation Work. In the event after making a good faith effort, any of the conditions in Section 6.6(a) have not been satisfied by the Commission (in Developers’ sole and absolute discretion) by the time set forth in the Development Schedule after taking diligent efforts, either Party may terminate this Agreement by providing written notice to the other Party and thereafter neither Party shall have any rights against or liability to the other under this Agreement, except as expressly set forth in this Agreement, including without limitation, the Commission's obligation to provide reimbursement pursuant to Section 5.1(d).
