Common use of Termination of Employment on Account of Disability Clause in Contracts

Termination of Employment on Account of Disability. Notwithstanding anything in this Agreement to the contrary, if Executive’s employment terminates on account of Disability, Executive shall be entitled to receive disability benefits under any disability program maintained by the Company that covers Executive, and Executive shall not be considered to have terminated employment under this Agreement and shall not receive benefits pursuant to Sections 2 and 3 hereof.

Termination of Employment on Account of Disability. Notwithstanding anything in this Agreement The Company shall have the right to involuntarily terminate the contrary, if Executive’s employment terminates effective after the determination that the Executive is unable to work due to a Disability. If the Executive incurs a Separation from Service with the Company on account of the Company’s termination of his employment for Disability, Executive shall be entitled to receive disability benefits under any disability program maintained by the Company that covers Executive, and Executive shall not be considered to have terminated employment under this Agreement and shall not receive benefits pursuant to Sections 2 and 3 hereof.then:
