Termination Notification. HUD is incorporating additional termination notification requirements to comply with section 6 of the United States Housing Act of 1937 (as may be amended, the “Act”) for public housing projects that convert assistance under RAD and to non-RAD PBV units located at this Covered Project. In addition to the regulations at 24 CFR § 983.257, related to Owner termination of tenancy and eviction, the Owner shall provide adequate written notice of termination of the Lease to Tenants which shall not be less than: i. A reasonable period of time, but not to exceed 30 days: • If the health or safety of other renters, NYCHA’s or Owner’s employees, or persons residing in the immediate vicinity of the Leased Premises is threatened; or • In the event of any drug-related or violent criminal activity or any felony conviction; ii. 14 days in the case of nonpayment of rent; and

i. A reasonable period of time, but not to exceed 30 days: • If the health or safety of other renters, NYCHA’s or Owner’s employees, or persons residing in the immediate vicinity of the Leased Premises is threatened; or • In the event of any drug-related or violent criminal activity or any felony conviction; iiwill address circumstances that fall outside of the scope of 24 CFR § 982.555(a)(1)(i)-(vi). 14 days in the case of nonpayment of rent; and
