Common use of Term of Agreement; Amendment Clause in Contracts

Term of Agreement; Amendment. This Agreement shall become effective as of the date first written above and will continue in effect for a period of three (3) years. This Agreement may be terminated by either party upon giving 90 days prior written notice to the other party or such shorter period as is mutually agreed upon by the parties. Term of Agreement; Amendment. This Agreement shall become effective as of the date first last written above in the signature page and will continue in effect for a period of three (3) years. This Agreement may be terminated by either party upon giving 90 days prior written notice to the other party or such shorter notice period as is mutually agreed upon by the parties. Subsequent to the end of the three (3) year period, this Agreement continues until one party gives 90 days prior written notice to the other party or such shorter notice period as is mutually agreed upon by the parties. Notwithstanding the foregoing, this Agreement may be terminated by any party upon the breach of the other party of any material term of this Agreement if such breach is not cured within 15 days of notice of such breach to the breaching party. This Agreement may not be amended or modified in any manner except by written agreement executed by Fund Services USBFS and the TrustFund, and authorized or approved by the Board of Trustees.

Notwithstanding the foregoing, this Agreement may be terminated by any party of the parties upon the breach of the other party of any material term of this Agreement if such breach is not cured within 15 days of notice of such breach to the breaching party. This Agreement may not be amended or modified in any manner except by written agreement executed by Fund Services USBFS, CFS and the TrustFund, and authorized or approved by the Board of TrusteesDirectors of the Fund.

Notwithstanding the foregoing, this Agreement may be terminated by any party upon the breach of the other party of any material term of this Agreement if such breach is not cured within 15 days of notice of such breach to the breaching party. This Agreement may not be amended or modified in any manner except by written agreement executed by Fund Services USBGFS and the TrustFund, and authorized or approved by the Board of TrusteesDirectors.

Subsequent to the end of the three one (31) year period, this Agreement continues until one party gives 90 days prior written notice to the other party or such shorter notice period as is mutually agreed upon by the parties. Subsequent to the end of the three (3) year period, this Agreement continues until one party gives 90 days prior written notice to the other party or such shorter period as is mutually agreed upon by the parties. Notwithstanding the foregoing, this Agreement may be terminated by any party upon the breach of the other party of any material term of this Agreement if such breach is not cured within 15 30 calendar days of notice of such breach to the breaching party. This Agreement may not be amended or modified in any manner except by written agreement executed by Fund Services USBFS and the TrustFund, and authorized or approved by the Board of TrusteesDirectors.

Term of Agreement; Amendment. This Agreement shall become effective with respect to a Fund(s) as of the date first written above the applicable Schedule B amendment for such Fund(s) is approved by the Board of Trustees of the Trust. This Agreement shall have an initial term of two (2) years and will shall continue in effect for a period of three (3) yearsthereafter so long as the continuation is annually approved. This Agreement may be terminated by either party upon giving 90 days prior written notice to the other party or such shorter period as is mutually agreed upon by the parties. Subsequent to the end of the three (3) year period, this Agreement continues until one party gives 90 days prior written notice to the other party or such shorter period as is mutually agreed upon by the parties. Notwithstanding the foregoing, this Agreement may be terminated by any party upon the breach of the other party of any material term of this Agreement if such breach is not cured within 15 days of notice of such breach to the breaching party. This Agreement may not be amended or modified in any manner except by written agreement executed by Fund Services MFAC and the Trust, and authorized or approved by the Board of Trustees.
