Common use of Tenant’s Space Plans Clause in Contracts

Tenant’s Space Plans. Landlord and Tenant acknowledge and agree that the plan space plan attached hereto as Schedule 1 (the “Space Plan”) and the Basis of Design attached hereto as Schedule 2 (the “Basis of Design”) have been approved by both Landlord and Tenant. Landlord and Tenant further acknowledge and agree that any changes to the Space Plan and Basis of Design requested by Tenant constitute a Change Request the cost of which changes shall be paid for out of the TI Fund. Tenant shall be solely responsible for all costs incurred by Landlord to alter the Building (or Landlord’s plans for the Building) as a result of Tenant’s requested changes.

Landlord and Tenant acknowledge and agree that the plan space plan prepared by the TI Architect attached hereto as Schedule 1 (collectively, the “Space PlanPlans”) and the Basis of Design attached hereto as Schedule 2 tenant improvement specifications (the “Basis of DesignTI Specifications”) provided for on Schedule 2 have been approved by both Landlord and Tenant. Landlord and Tenant further acknowledge and agree that any changes to the Space Plan and Basis of Design requested by Tenant Plans or the TI Specifications constitute a Change Request the cost of which changes shall be paid for out of the TI Fundby Tenant. Tenant shall be solely responsible for all costs incurred by Landlord to alter the Building (or Landlord’s plans for the Building) as a result of Tenant’s requested changes.

Landlord and Tenant further acknowledge and agree that any changes to the Space Plan and Basis of Design requested by Tenant constitute Plans constitutes a Change Request the cost of which changes shall be paid for out of the TI Fundby Tenant.
