Temporary Office Space. From February 1, 1998, through the commencement date of the Lease (the "Pre-Occupancy Period"), Landlord (or an affiliate of Landlord) shall provide Tenant with approximately 300 square feet of space on the first floor of the building located at 800 Heinz Street, Berkeley, California, for use by three (3) employee▇ ▇▇ ▇▇▇▇▇▇ (▇▇▇ "▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇"). ▇enant shall take the Temporary Space on an "As-Is" basis. Monthly rent for the Temporary Space shall be $275 per month fully serviced from lease execution through occupancy of the finished spaces, payable on the first day of each month during the Pre-Occupancy Period. Tenant's occupancy of the Temporary Space shall be on all of the terms and conditions as specified in the Lease for Tenant's Occupancy of the Premises; and prior to Tenant's occupancy of the Temporary Space, Tenant shall deliver to Landlord certificates of Tenant's liability insurance coverage for the Temporary space showing Landlord (and the owner of the building, if other than Landlord) as an additional insured thereunder.
Temporary Office Space. The City will provide temporary office space of approximately 5,000 square feet (3,000 square feet of office and 2,000 square feet of storage) for a period of approximately 140 days. The location of such space shall be determined by the City. The Company shall pay all utilities for such space and shall maintain insurance. The City shall not charge rent to the Company. The space shall be available beginning January 1, 2001.

Notwithstanding anything herein to the contrary, Chesapeake, CHK and Canaan (the "Canaan Parties") will not be required to take any actions which will impose any expense, liability or payment obligation on the Canaan Parties in excess of the amounts that were being paid by Canaan under the Lease or the Equipment Leases prior to the date of the Merger Agreement and the Canaan Parties will not be required to amend, renew, extend or expand the Lease or any of the Equipment Leases.

However, Developer shall pay its pro rata share of any actual out of pocket costs for utilities supplied to the Temporary Office Space during Developer’s period of occupancy prior to the Termination Date based on either separate meter(s) or other evidence reasonably satisfactory to Developer of its share of such costs. If Developer wishes to use all or any portion of the Temporary Office Space following the Termination Date, such space shall be leased to Developer for the fair market rental value thereof. Developer acknowledges that such Temporary Office Space may be located in building(s) that are not owned by Casa Grande or Pinal County, in which event Developer may, at its option, enter into a lease directly with the owner of such Temporary Office Space on the term and conditions set forth in this Section.

Temporary Office Space. Simultaneous with the execution of this Lease, Tenant may occupy the space shown on Exhibit K hereto, rent free, including furniture and phone service, for a maximum of twenty (20) employees until the Commencement Date of this Lease, at which time Tenant shall promptly surrender possession of the office area described in the Temporary Lease and return such space in the condition that it was first provided to Tenant.
