Common use of Technical Problems Clause in Contracts

Technical Problems. DigitalWork agrees to use commercially reasonable efforts to address material technical problems (over which DigitalWork exercises control) affecting use by AOL Members of the Co-Branded Site (a "DigitalWork Technical Problem") promptly following notice thereof. In the event that DigitalWork is unable to promptly resolve a DigitalWork Technical Problem following notice thereof from AOL (including, without limitation, infrastructure deficiencies producing user delays), AOL will have the right to regulate the promotions it provides to DigitalWork hereunder until such time as DigitalWork corrects the DigitalWork Technical Problem at issue.
