Common use of Teacher Notification of Potentially Dangerous Student(s Clause in Contracts

Teacher Notification of Potentially Dangerous Student(s. 4 Pursuant to Ed Code Section 49079, the District shall inform the bargaining 6 to have engaged in, any of the acts described in any of the subdivisions, 7 except subdivision (h), of section 48900 or in section 48900.2, 48900.3, 8 48900.4 or 48900.7 that the pupil engaged in, or is reasonably suspected 9 to have engaged in, those acts. The district shall provide the information to 10 the bargaining unit member based upon any records that the district 11 maintains in its ordinary course of business, or receives from a law 12 enforcement agency, regarding a pupil described in this section. Any 13 information received by the bargaining unit member under this section shall 14 be maintained in confidence for the limited purpose for which it was 15 provided, and shall not be further disseminated by the bargaining unit 16 member. Bargaining unit members will receive written notice 24 hours in 17 advance, or immediately upon site notification, of the pupil’s permanent 18 classroom placement, Bargaining unit members will receive the written 19 notice at the beginning of the school year, or within 48 hours of the District’s 20 knowledge of the pupil’s qualification under Ed Code Section 49070.

The district 10 shall provide the information to 10 the bargaining unit member based upon 11 any records that the district 11 maintains in its ordinary course of business, or 12 receives from a law 12 enforcement agency, regarding a pupil described in 13 this section. Any 13 information received by the bargaining unit member 14 under this section shall 14 be maintained in confidence for the limited 15 purpose for which it was 15 provided, and shall not be further disseminated 16 by the bargaining unit 16 member.
