Yorum faaliyeti bakımından, lehdarın sözleşmenin kuruluşunda hazır bulunması162 veya vaadedenin edim yükümlülüğünün onun lehine kararlaştırıldığının açıkça belirtilmiş olması163, tam üçüncü kişi yararına sözleşmenin varlığı yönünde birer ipucu olarak değerlendirilebilir, fakat onun varlığına kesin delil teşkil etmez. Ayrıca sözleşme taraflarının sözleşmenin kuruluşunun ardından lehdara yaptıkları irade açıklamaları iradelerin yorumu bakımından ölçüt sayılabilir164. Fakat bu açıklamalar incelenirken dikkat edilmesi gereken husus, bunların sözleşme taraflarının sözleşmenin kuruluşu sırasındaki ortak iradesini yansıtıp yansıtmadığıdır.
