Common use of Tangible Property Clause in Contracts

Tangible Property. The facilities, machinery, equipment, furniture, buildings and other improvements, fixtures, vehicles, structures, any related capitalized items and other tangible property material to the business of the Company (collectively, the "Tangible Property") are in all material respects in adequate operating condition, subject to continued repair and replacement in accordance with past practice, and are suitable for their intended use in accordance with past practice. During the past three years there has not been any significant interruption of the operations of the Company due to inadequate maintenance of the Tangible Property.

Tangible Property. The facilities, machinery, equipment, furniture, buildings and other improvements, fixtures, vehicles, structures, any related capitalized items and other tangible property material to the business of the Company (collectively, the "Tangible Property") are in all material respects in adequate good operating conditioncondition and repair, subject to continued repair and replacement in accordance with past practice, and are suitable for their intended use in accordance with past practiceuse. During the past three years there has not been any significant material 17 11 interruption of the operations of the Company due to inadequate maintenance of the Tangible Property.

Tangible Property. The buildings, facilities, machinery, equipment, computers, furniture, buildings leasehold and other improvements, fixtures, vehicles, structures, any related capitalized items and other tangible property material related to the business of Business, other than Inventory (the Company (collectively, the "“Tangible Property"”) are in all material respects in adequate satisfactory operating condition, condition and repair (normal wear and tear excepted) and are subject to continued repair and replacement in accordance with past practice. Since the inception of the Seller, and are suitable for their intended use in accordance with past practice. During the past three years there has not been any significant interruption of the operations of the Company Business due to inadequate maintenance of the Tangible Property.

Tangible Property. During the past three years there has not been any significant interruption of the operations of the Company Seller due to inadequate maintenance of the Tangible Property.

During the past three years there has not been any significant interruption of the operations of the Company or its subsidiaries due to inadequate maintenance of the Tangible Property.

Tangible Property. During the past three years there has not been any significant interruption of the operations of the Company or any of the Subsidiaries due to inadequate maintenance of the Tangible Property.
