T ime Limits Clause Samples
The "Time Limits" clause establishes specific deadlines or periods within which certain actions or obligations must be completed under the agreement. For example, it may set a timeframe for delivering goods, submitting notices, or performing services, ensuring that all parties are aware of and adhere to these schedules. By clearly defining these timeframes, the clause helps prevent disputes over delays and ensures that the contract progresses in an orderly and predictable manner.
T ime Limits. The time limits and steps specified above may be waived by mutual agreement of the parties to the grievance. If the District fails to meet the time limits specified in Steps 1 through 3 above, the grievance will automatically move to the next step. If a grievant fails to meet the time limits specified in Steps 1 through 5 above, the grievance will be deemed to have been settled and withdrawn.
T ime Limits. Time limits set forth in the following steps may only be extended by mutual written consent of the parties hereto. A time limit which ends on a Saturday, Sunday or a holiday designated in article 12.4 hereof shall be deemed to end at 4:30 p.m. on the next following business day. Failure of an employee to file a grievance on a timely basis or to timely advance a grievance in accordance with the time limits set forth below will constitute withdrawal of the grievance. Failure of the Employer to comply with the time limits set forth below shall result in the grievance being automatically elevated to the next step without any action necessary on the part of the employee. NOTE: A grievance concerning a termination or suspension may start at Step 2 of the grievance procedure, otherwise steps in the grievance procedure may only be skipped with mutual agreement. The union will make a good faith effort to timely withdraw inactive grievances.
T ime Limits. 1. The number of days indicated on each level shall be considered as a maximum. The time limits specified may, by mutual agreement, be enlarged or reduced.
2. The failure of an Aggrieved Person to proceed to the next level within the specified time limits shall be deemed to be an acceptance of the decision rendered at the level last resorted to and shall constitute a waiver of any further proceedings on the basis of the Grievance in question.
3. In the event a Grievance is filed at such time that it cannot be processed through all the steps in this Grievance Procedure by the end of the school year, and, if left unresolved until the beginning of the following school year, could result in irreparable harm to a Party of Interest; the time limits set forth herein shall be reduced so that the Grievance Procedure may be exhausted prior to the end of the school year or as soon thereafter as is practicable.
T ime Limits. Each grievance shall be processed rapidly. The number of days indicated at a step of the procedure shall be maximums, unless extended by mutual consent. If the grievant fails to meet the deadline at any step of the procedure, the grievance shall be considered waived. If the Association files a grievance that involves an institutional Association interest (such as an alleged failure to properly deduct and forward Association dues or fair share fees) as opposed to an individual employee interest (such as an allegedly improper disciplinary action or transfer), the time limit for initiating a grievance will be measured from the date the Association became aware, or reasonably should have become aware, of the claimed misinterpretation, misapplication or violation of this Agreement.

Failure of the Employer to comply with the time limits set forth below shall result in the grievance being automatically elevated to the next step without any action necessary on the part of the employee, provided that the Union must specifically request arbitration as provided in Step 4.
T ime Limits. Failure of any grievant to act on a grievance within the prescribed time limits will act as a ban to any further appeal and the administration’s failure to give a written decision within the prescribed time limits shall permit the grievant to move to the next step.
T ime Limits. All time limits referred to in the grievance procedure shall be deemed to be mandatory unless extended by mutual written agreement of the Company and the union. If the grievance is not responded to by the Company within the agreed time limit, the Union may refer the grievance to the next step of the grievance procedure. If the grievance is not presented by the Union at any step in accordance with the prescribed time limits, the grievance is deemed to be withdrawn.
T ime Limits. No grievance shall be entertained or processed unless it is submitted within ten (10) working days after the first occurrence of the event giving rise to the grievance. If a grievance is not presented within the time limits set forth above, it shall be considered “waived.” If a grievance is not appealed to the next step within the specified time limit or any agreed extension thereof, it shall be considered settled on the basis of the City’s last answer. If the City does not answer a grievance or an appeal thereof within the specified time limits, the grievant and the Union may elect to treat the grievance as denied at that step and immediately appeal the grievance to the next step in accordance with the procedure set forth in this Article. Any time limit set forth in the Article may be extended by mutual agreement in writing.
T ime Limits. Time limits specified herein may be waived by mutual agreement in writing. Failure of the Employer to respond within the prescribed or agreed time limits at any step shall entitle the Union to proceed to the next step. Failure of the Union to respond within the prescribed or agreed time limits shall constitute abandonment of the grievance.
