SYSTEM PERFORMANCE PLAN. [Deleted] [Deleted] If the actual NPAC to LSMS Interface Transaction Rate (as contemplated by SLR 6 in Exhibit G) meets or exceeds ten (10) transactions per second during at least fifteen percent (15%) of the time intervals, during a calendar month, in respect of which Contractor measures and reports transaction rates as at the date of this Agreement, then the parties shall, within ninety (90) days thereafter, negotiate and implement a system performance plan (the "Performance Plan") to increase such throughput capacity to twenty-five (25) transactions per second. The Performance Plan shall define measurements and milestone requirements of throughput performance, including both system peek throughput capacity and timing for attainment of specified levels. Should the parties fail to agree upon the Performance Plan within such ninety (90) day period, the applicable throughput performance requirement shall be as specified in the NANC NPAC/SMS Functional Requirements Specification (namely, for greater certainty, twenty-five (25) transactions per second). [Amended] The Performance Plan, when completed, shall become a part of this Agreement and shall be incorporated herein as Exhibit N.

  • Service Plan 2.1 The Customer shall use the following applicable Service Plan and services during the Term:

  • KEY PERFORMANCE INDICATORS 10.1 The Supplier shall at all times during the Framework Period comply with the Key Performance Indicators and achieve the KPI Targets set out in Part B of Framework Schedule 2 (Goods and/or Services and Key Performance Indicators).

  • Ongoing Performance Measures The Department intends to use performance-reporting tools in order to measure the performance of Contractor(s). These tools will include the Contractor Performance Survey (Exhibit H), to be completed by Customers on a quarterly basis. Such measures will allow the Department to better track Vendor performance through the term of the Contract(s) and ensure that Contractor(s) consistently provide quality services to the State and its Customers. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MFMP or on the Department's website).

  • Employee Performance Review When a formal review of an employee’s performance is made, the employee concerned shall be given an opportunity to discuss, sign and make written comments on the review form in question and the employee is to receive a signed copy to indicate that its contents have been read. An employee shall be entitled to a minimum of two (2) work days to review the performance review prior to providing any response to the Employer, verbally or in writing, with respect to the evaluation.

  • PERFORMANCE MANAGEMENT SYSTEM 5.1 The Employee agrees to participate in the performance management system that the Employer adopts or introduces for the Employer, management and municipal staff of the Employer.

  • Annual Performance Evaluation On either a fiscal year or calendar year basis, (consistently applied from year to year), the Bank shall conduct an annual evaluation of Executive’s performance. The annual performance evaluation proceedings shall be included in the minutes of the Board meeting that next follows such annual performance review.

  • Incentive Program Members who are rated as either Level I, Level II or Level III in every phase of the Physical Fitness Test are eligible to participate in the Incentive Program.

  • Historical Performance Information To the extent agreed upon by the parties, the Sub-Advisor will provide the Trust with historical performance information on similarly managed investment companies or for other accounts to be included in the Prospectus or for any other uses permitted by applicable law.

  • Registry Performance Specifications Registry Performance Specifications for operation of the TLD will be as set forth in Specification 10 attached hereto (“Specification 10”). Registry Operator shall comply with such Performance Specifications and, for a period of at least one (1) year, shall keep technical and operational records sufficient to evidence compliance with such specifications for each calendar year during the Term.

  • Performance Schedule The Parties will perform their respective responsibilities in accordance with the Performance Schedule. By executing this Agreement, Customer authorizes Motorola to proceed with contract performance.
