Common use of Surrender Premises Clause in Contracts

Surrender Premises. Tenant shall have ten (10) business days after the Suite 220A Commencement Date (the “Surrender Deadline”) to surrender six hundred ninety-three (693) square feet of Rentable Area (commonly known as Suite 215) located on the second (2nd) floor of the Building as shown on Exhibit B attached hereto (the “Surrender Premises”) to Landlord (a) in the condition and (b) with all documentation required under the Lease. If Tenant does not surrender the Surrender Premises in accordance with Article 27 of the Amended Lease by the Surrender Deadline, then Tenant, pursuant to Article 28 of the Amended Lease, shall be become a tenant at sufferance with respect to the Surrender Premises until the actual date (the “Surrender Date”) that Tenant surrenders the Surrender Premises to Landlord in accordance with Article 27 of the Amended Lease and this Section. As of the Surrender Date, the Amended Lease shall terminate and be of no further force or effect with regard to the Surrender Premises, except for those provisions that, by their express terms, survive the expiration or earlier termination of the Amended Lease.

Surrender Premises. Tenant shall have ten (10) business days after surrender the Suite 220A Surrender Premises to Landlord on or before the Substitute Premises Commencement Date (the “Surrender Deadline”) to surrender six hundred ninety-three (693) square feet in accordance with Section 28 and all other provisions of Rentable Area (commonly known as Suite 215) located on the second (2nd) floor of the Building as shown on Exhibit B attached hereto (the “Surrender Premises”) to Landlord (a) in the condition and (b) with all documentation required under the Lease. If Tenant does not fails to timely surrender the Original Premises as required in this Section 4, then Tenant shall, among other things, be liable for holdover rent as set forth in Section 8 of the Lease. The date on which Tenant performs its obligations under the Lease and this Second Amendment with respect to its surrender of the Surrender Premises in accordance with Article 27 of the Amended Lease by the Surrender Deadline, then Tenant, pursuant to Article 28 of the Amended Lease, shall be become a tenant at sufferance deemed the “Surrender Date”. The Lease with respect to the Surrender Premises until shall terminate on the actual date (the “Surrender Date”) that Tenant surrenders the Surrender Premises to Landlord in accordance with Article 27 of the Amended Lease . From and this Section. As of after the Surrender Date, the Amended Lease Tenant shall terminate and be of have no further force or effect rights of any kind with regard respect to the Surrender Premises. Notwithstanding the foregoing, except for those provisions thatof the Lease which, by their express terms, survive the expiration or earlier termination of the Amended LeaseLease shall survive the surrender of the Surrender Premises and termination of the Lease with respect to the Surrender Premises as provided for herein. Nothing herein shall excuse Tenant from its obligations under the Lease with respect to the Surrender Premises prior to the Surrender Date.
