SUPPLIED DATA. Purchaser acknowledges that TGW Systems has relied upon specifications, representations of operating conditions and other data supplied by Purchaser to TGW Systems in the selection and design of equipment and the preparation of this Proposal. In the event that actual operating conditions or any other conditions differ from those represented by Purchaser, any warranties contained herein which are or may be affected by such conditions shall be null and void, unless otherwise mutually agreed upon in writing by Purchaser and TGW Systems.
SUPPLIED DATA. MS will provide FF with all engineering, package and installation drawings, specifications, testing protocols and results, documents, data (including metadata and digital data), geometric and functional attributes, information related to MS’s production, delivery, logistics, quality, volume or similar business information regarding the FF81 Products and other information relating to the FF81 Products, including detailed design and manufacturing information such as failure mode and effects analyses (FMEA, including design failure mode and effects analysis (DFMEA) and process failure mode and effects analysis (PFMEA)), design verification plans and reports (DVP&R, including test specifications, test reports and test data), p-diagrams and control plans related to the FF81 Products (collectively, “Supplied Data”) as and when reasonably requested by FF. Subject to the last sentence of this subsection (a), FF may use the Supplied Data for any purpose in connection with the FF81 Products. FF will keep Supplied Data separate from any other FF data assets. The formatting and specifications of all Supplied Data provided to FF by MS shall be as reasonably specified by FF or as otherwise agreed upon by the Parties. Supplied Data will be subject to the confidentiality restrictions set out in Section 18 above.
SUPPLIED DATA. Catalog or product information and pricing data provided by Customer for Customer and contained in a Marketplace. (k) TRANSACTION DATA. Information and data characterizing, describing, relating to or comprising transactions (e.g., the sale and purchase of goods and services) between Customer and a Member which are conducted in whole or part over or through use of any Marketplace. Transaction Data also includes, for any transaction to which Customer is a party, information or data relating to the parties of such transaction other than Customer which is communicated or furnished by such parties to Customer or otherwise obtained by Customer in the course of such transaction.

  • De-Identified Data Provider agrees not to attempt to re-identify de-identified Student Data. De-Identified Data may be used by the Provider for those purposes allowed under FERPA and the following purposes: (1) assisting the LEA or other governmental agencies in conducting research and other studies; and (2) research and development of the Provider's educational sites, services, or applications, and to demonstrate the effectiveness of the Services; and (3) for adaptive learning purpose and for customized student learning. Provider's use of De-Identified Data shall survive termination of this DPA or any request by ▇▇▇ to return or destroy Student Data. Except for Subprocessors, ▇▇▇▇▇▇▇▇ agrees not to transfer de- identified Student Data to any party unless (a) that party agrees in writing not to attempt re-identification, and (b) prior written notice has been given to the LEA who has provided prior written consent for such transfer. Prior to publishing any document that names the LEA explicitly or indirectly, the Provider shall obtain the LEA’s written approval of the manner in which de-identified data is presented.

  • Covered Data All instances of "Student Data" should be replaced with "LEA Data". The protections provided within this DPA extend to all data provided to or collected by the Provider.

  • Metering Data At Developer’s expense, the metered data shall be telemetered to one or more locations designated by Connecting Transmission Owner, Developer and NYISO. Such telemetered data shall be used, under normal operating conditions, as the official measurement of the amount of energy delivered from the Large Generating Facility to the Point of Interconnection.

  • Product Warranty Seller provides general warranties of fitness and general warranties that the goods are free from defects, for 1 year from acceptance of the goods, except as may otherwise be set forth in the Description/Proposal, or other attached warranty.

  • Encounter Data Party shall provide encounter data to the Agency of Human Services and/or its departments and ensure further that the data and services provided can be linked to and supported by enrollee eligibility files maintained by the State.
