Common use of Supervisory Responsibility Clause in Contracts

Supervisory Responsibility. All Complaints against a Police Officer or Sergeant will be under the direction of the Chief of Police or Designee who will assign a supervisor to conduct and/or assist in the investigation. If the investigating supervisor is involved in the incident complained of, then the Chief shall assign a supervisor of a rank higher than the Member under investigation to conduct the investigation. Once the investigation is concluded, an investigation report shall be submitted, with recommendations for disposition, to the Chief through the chain of the command of the Member under investigation. The Chief of Police or Designee retains the right to have an internal investigation conducted by an independent party outside of the department. If the Chief of Police or Designee decides to utilize an outside investigator, he/she will provide written notice to the Lodge regarding selection of the outside investigator and the investigator’s information.
