Common use of SUBSTANCE ABUSE TESTING PROGRAM Clause in Contracts

SUBSTANCE ABUSE TESTING PROGRAM. 265. The City and Union agree to continue to meet and confer in good faith to establish a mutually agreed upon substance-abuse testing program to be implemented during the term of the Agreement, for safety-sensitive employees in positions that are not currently covered by the federal Department of Transportation testing regulations. If the parties cannot reach agreement on or before January 15, 2013, Arbitrator Xxxxx Xxxxxxxxx shall be retained by the parties to issue an advisory arbitration decision on or before March 15, 2013.
