Starbucks. The following summarizes our discussion regarding the installation of Starbucks operations in identified Metro stores that are subject to the Sav-A-Centre (SAC) Collective Agreement between the parties dated September 30, 2019. Starbucks at these locations will be considered to be part of the store, managed by the Store Manager and covered by the aforementioned Collective Agreement. The following sets out those Collective Agreement terms applicable to the Starbucks that differ from said Collective Agreement.

Starbucks. Section 4.4 requires the Landlord to pay the Tenant an improvement Allowance in the amount of $25.00 per square foot or $45,075.00. We require the Tenant to state in their estoppel certificate that they are no longer owed the Tenant improvement Allowance. The estoppel will state that the Landlord’s Contribution obligations have been satisfactorily completed by Landlord, or Seller will provide written confirmation reasonably satisfactory to Buyer as to the foregoing. TITLE OBJECTIONS (TO THE FOLLOWING PTR SCHEDULE B SPECIAL EXCEPTIONS): “EXCEPTION 11; ACCESS EASEMENT. BUYER OBJECTS TO EXCEPTION 11 IN LIGHT OF THE FACT SUCH ACCESS EASEMENT AUTOMATICALLY TERMINATES, PER ITS TERMS, UPON APPROVAL OF THE EXTENSION OF A PUBLIC STREET AT THE SHOPPING CENTER. SUBSEQUENT TO THE DATE OF SUCH EASEMENT, CAMINO XXXXXX AND XXXXXXXX ROAD WERE DEDICATED TO THE PUBLIC. BUYER WILL REQUIRE THAT SELLER DETERMINE WHETHER SUCH QUIT CLAIM DEEDS HAVE BEEN RECORDED AND, IF SO, CAUSE THE TITLE COMPANY TO DELETE SUCH EXCEPTION FROM THE PTR.” RESPONSE: SELLER WILL COMPLY WITH BUYER’S REQUEST TO DETERMINE WHETHER SUCH QUIT CLAIM DEED(S) HAVE BEEN RECORDED AND, IF SO, REQUEST THE TITLE COMPANY TO DELETE THIS EXCEPTION FROM THE PTR.

Xxxxxx’x Bistro: Our all-you-care-to-eat style bistro is located on the second floor of the Xxxxxxxx Center. This more traditional university dining outlet offers breakfast, brunch/lunch and dinner. Menu offerings include salad bar, deli, grill, pizza, international as well as traditional options. One meal swipe allows a customer to re-enter as many times as they choose, during that visit.
