Common use of Standards of Performance Clause in Contracts

Standards of Performance. A. Standard of Care: The standard of care for all professional engineering and related services performed or furnished by Engineer under this Agreement will be the care and skill ordinarily used by members of the subject profession practicing under similar circumstances at the same time and in the same locality. Engineer makes no warranties, express or implied, under this Agreement or otherwise, in connection with any services performed or furnished by Engineer.

Standards of Performance. A. Standard of Care: The standard of care for all Engineer shall perform the professional engineering and related services performed or furnished required by Engineer each Service Order issued under this Agreement will be with the professional skill and care and skill ordinarily used provided by members of the subject profession competent engineers practicing under the same or similar circumstances at and professional license, and as expeditiously as is prudent considering the same time ordinary professional skill and in the same locality. Engineer makes no warranties, express or implied, under this Agreement or otherwise, in connection with any services performed or furnished by Engineercare of a competent engineer.
