Common use of Staging Clause in Contracts

Staging. In addition to the staging categories listed in paragraph 1 of Annex 2-A, this Schedule contains staging categories 20-A, 20-B, PR-1 and PR-130: (a) customs duties on originating goods provided for in the items in staging category “20-A” shall remain at base rates during years one through 10. Beginning on January 1 of the year 11, customs duties shall be removed in ten equal annual stages, and such goods shall be duty-free, effective January 1 of year 20; (b) customs duties on originating goods provided for in the items in staging category “20-B” shall remain at base rates during years one through 12. Beginning on January 1 of the year 13, customs duties shall be removed in eight equal annual stages, and such goods shall be duty-free, effective January 1 of year 20; (c) customs duties on originating goods provided for in the items in staging category “PR-1” shall be reduced by one percent of the base rate on the date this Agreement enters into force; and (d) customs duties on originating goods provided for in the items in staging category “PR-130” shall be reduced to 130 percent ad valorem in ten equal annual stages beginning on the date this Agreement enters into force, and such goods shall remain at 130 percent ad valorem, effective January 1 of year 10. 1. This Appendix applies to tariff rate quotas (TRQs) provided for in this Agreement and sets out modifications to the Harmonized Schedule of Korea (HSK) that reflect the TRQs that Korea shall apply to certain originating goods under this Agreement. In particular, originating goods of China included under this Appendix shall be subject to the rates of duty as set out in this Appendix in lieu of the rates of duty specified in Chapters 1-97 of the HSK. Notwithstanding any other provision of the HSK, originating goods of China in the quantities described in this Appendix shall be permitted entry into the territory of Korea as provided in this Appendix. Furthermore, any quantity of originating goods imported from China under a TRQ provided for in this Appendix shall not be counted toward the in-quota amount of any TRQ provided for such goods elsewhere in the HSK. In the aforementioned WTO document, Korea committed, inter alia, to increasing minimum market access for the items identified in staging category Y during the period 2005 to 2014; and (m) duties on originating goods provided for in the items in staging category Z shall be reduced to 20 percent ad valorem on the date this Agreement enters into force. Beginning January 1 of year two, duties shall be removed in nine equal annual stages, and such goods shall be duty-free, effective January 1 of year ten.

(ii) For goods described in tariff category 9802.00.80, at the time of entry the duty imposed upon the assembled article to be applied in accordance with the procedures specified in U.S. note 4 of subchapter II, chapter 98, of the HTS, shall be the rate applicable to the full value of the article itself under the staging obligations set forth for the appropriate provision in Chapters 1 to 97 of this schedule. (iii) For goods described in tariff category 9818.00.05, at the time of entry the duty imposed upon the cost of such parts shall be the rate applicable to the full value of such parts under the staging obligations set forth for the appropriate provision in Chapters 1 to 97 of this schedule. (g) Duties on goods provided for in the items in staging category T1 shall be treated as follows: If the base rate is greater than three percent , the United States will apply a rate of three percent, from entry into force through December 31, 2009. Such goods shall be duty-free effective January 1, 2010. (h) Duties on goods provided for in the items in staging category TX shall be treated as follows: If the base rate is greater than three percent and less than 5.5 percent the United States will apply a rate that is 0.9 percent of its base rate, from entry into force through December 31, 2009. Beginning on January 1, 2010, the United States will apply the lower of the rate that was in effect on December 31, 2009 or three percent . Such goods shall be duty-free effective January 1, 2015. (i) Duties on goods provided for in the items in staging category T2 shall be treated as follows: If the base rate is greater than three percent and less than eight percent , the United States will apply a rate that is 0.9 percent of its base rate, from entry into force through December 31, 2009. Beginning on January 1, 2010, the United States will apply the lower of the rate that was in effect on December 31, 2009, or three percent. Such goods shall be duty- free effective January 1, 2015. (j) Duties on goods provided for in the items in staging category T3 shall be treated as follows: If the base rate is greater than three percent and less than 15.5 percent the United States will apply a rate that is 0.9 percent% of its base rate, from entry into force through December 31, 2009. ANNEX I TARIFF-RATE QUOTAS 1. This annex contains temporary modifications of the provisions of the HTSUS pursuant to this Agreement. Originating goods of Australia described in the provisions of this annex are subject to duty at the rate set out forth in this Appendix annex in lieu of the rates of duty specified rate provided therefore in Chapters 1-97 of the HSK1 through 97. Notwithstanding any other provision of tariff-rate quota provisions provided for elsewhere in the HSKHTSUS, originating goods of China in the quantities described in this Appendix Australia shall be permitted entry into to enter the territory United States in accordance with the provisions of Korea as provided in this Appendixannex. Furthermore, any quantity of originating goods imported from China under a TRQ provided for Australia on goods described in this Appendix annex shall not be counted toward the inany tariff-rate quota amount of any TRQ provided for such goods elsewhere in the HSKHTSUS. Originating goods of Australia imported into the United States also shall not be subject to any of the provisions, duties or limitations of Subchapter IV of Chapter 99 of the HTSUS. (a) The Duties on goods entered from Australia for the quantities explicitly reserved for Australia pursuant to the provisions of Additional U.S. Note 3 in Chapter 2 of the HTSUS shall be removed in accordance with the provisions of staging category A in Annex 2-B, paragraph 2(a). 3. Beginning 1 January of year two, customs duties shall be removed in four equal annual stages, and such goods shall be free of customs duty, effective 1 January of year five; (q) customs duties on originating goods provided for in the items in staging category “S-5” shall be subject to the following provisions: (i) for goods entered into Korea from 1 November through 30 April, customs duties shall remain at base rates; and (ii) for goods entered into Korea from 1 May through 31 October, customs duties shall be removed in 15 equal annual stages beginning on the date of entry into force of this Agreement, and such goods shall be free of customs duty, effective 1 January of year 15; (r) customs duties on originating goods provided for in the items in staging category “E” shall remain at base rates; and (s) no obligations regarding customs duties in this Agreement shall apply with respect to items in staging category “R”. Nothing in this Agreement shall affect Korea’s rights and obligations with respect to its implementation of the commitments set out in the WTO document WT/Let/492 (Certification of Modifications and Rectifications to Schedule LX – Republic of Korea) dated 13 April, 2005 and any amendments thereto.

Staging. In addition to the staging categories listed in paragraph 1 of Annex 2-A, this Schedule contains staging categories 20▇▇-A, 20▇▇-B, PR-1 ▇▇-▇ and PR-130: (a) customs duties on originating goods provided for in the items in staging category “20-A” shall remain at base rates during years one through 10. Beginning on January 1 of the year 11, customs duties shall be removed in ten equal annual stages, and such goods shall be duty-free, effective January 1 of year 20; (b) customs duties on originating goods provided for in the items in staging category “20-B” shall remain at base rates during years one through 12. Beginning on January 1 of the year 13, customs duties shall be removed in eight equal annual stages, and such goods shall be duty-free, effective January 1 of year 20; (c) customs duties on originating goods provided for in the items in staging category “PR-1” shall be reduced by one percent of the base rate on the date this Agreement enters into force; and (d) customs duties on originating goods provided for in the items in staging category “PR-130” shall be reduced to 130 percent ad valorem in ten equal annual stages beginning on the date this Agreement enters into force, and such goods shall remain at 130 percent ad valorem, effective January 1 of year 10. 1. This Appendix applies to tariff rate quotas (TRQs) provided for in this Agreement and sets out modifications to the Harmonized Schedule of Korea (HSK) that reflect the TRQs that Korea shall apply to certain originating goods under this Agreement. In particular, originating goods of China included under this Appendix shall be subject to the rates of duty as set out in this Appendix in lieu of the rates of duty specified in Chapters 1-97 of the HSK. Notwithstanding any other provision of the HSK, originating goods of China in the quantities described in this Appendix shall be permitted entry into the territory of Korea as provided in this Appendix. Furthermore, any quantity of originating goods imported from China under a TRQ provided for in this Appendix shall not be counted toward the in-quota amount of any TRQ provided for such goods elsewhere in the HSK.
