Contract Provisions The Recipient will ensure that all Contracts are consistent with and incorporate the relevant provisions of the Agreement, including its insurance provisions. More specifically, but without limiting the generality of the foregoing, the Recipient agrees to include provisions in all Contracts to ensure:
REFERENCED CONTRACT PROVISIONS Term provision and Amount Not To Exceed provision, of the Contract are deleted in their entirety and replaced with the following: “Term: July 1, 2018 through June 30, 2023 Period One means the period from July 1, 2018 through June 30, 2019 Period Two means the period from July 1, 2019 through June 30, 2020 Period Three means the period from July 1, 2020 through June 30, 2021 Period Four means the period from July 1, 2021 through June 30, 2022 Period Five means the period from July 1, 2022 through June 30, 2023 Amount Not To Exceed Period One Amount Not To Exceed: $ 2,875,111 Period Two Amount Not To Exceed: 3,200,000 Period Three Amount Not To Exceed: 3,550,000 Period Four Amount Not To Exceed: 3,300,000 Period Five Amount Not To Exceed: 3,500,000 TOTAL AMOUNT NOT TO EXCEED: $16,425,111”
Special Provisions 2 A. CONTRACTOR shall not use the funds provided by means of this Agreement for the following 3 purposes:
SPECIAL PROVISION The failure of the COUNTY to insist upon the strict performance of any provision of this Agreement or to exercise any right based upon breach thereof or the acceptance of any performance during such breach shall not constitute a waiver of any right under this Agreement.
Financial Provisions Any cooperative activities envisaged or undertaken under this Agreement shall be subject to the availability of resources and to the laws, regulations and policies of the Parties. Costs of cooperative activities shall be borne in such manner as may be mutually determined from time to time between the Parties.
