Common use of Special Exception Clause in Contracts

Special Exception. Anything in this Agreement to the contrary notwithstanding, it is understood that the covenants and restrictions of this Agreement shall not apply to any shares of Class A Stock or Class B Stock (i) owned by ▇▇▇▇▇▇▇▇▇, Lufkin & ▇▇▇▇▇▇▇▇ Securities Corporation, other than those shares listed on Exhibit A hereto or (ii) owned or controlled by ▇▇▇▇ ▇. ▇▇▇▇▇, other than those shares listed on Exhibit A hereto or (iii) owned or controlled by ▇▇▇▇▇▇ Investments or any fund managed by ▇▇▇▇▇▇ Investments.
