Common use of Source Code and Documentation Clause in Contracts

Source Code and Documentation. Vendor acknowledges and agrees that it or Vendor Contractors shall deliver and provide to the State all Source Code and Documentation related to any Software or other Deliverables that are created, developed, produced, delivered, performed or provided by or on behalf of, or made available through, Vendor, Vendor Contractors, or Vendor Personnel, directly or indirectly, hereunder, unless otherwise agreed to in writing by the State.

Source Code and Documentation. To the extent set forth in an applicable Purchasing Instrument, Vendor acknowledges and agrees that it or Vendor Contractors shall deliver and provide to the State applicable Governmental Entity all Source Code and Documentation related to any Software or other Deliverables that are created, developed, produced, delivered, or performed or provided by or on behalf of, or made available through, Vendor, Vendor Contractors, or Vendor Personnel, directly or indirectly, hereunder, unless otherwise agreed to in writing by the State.
